2. Description of Service

ExamZen is a mobile application designed to help users manage exam-related stress and anxiety through evidence-based psychological techniques, including but not limited to:

• Breathing exercises
• Eye movement exercises (EMDR-inspired)
• Cognitive Behavioral Therapy (CBT) tools
• Acceptance and Commitment Therapy (ACT) exercises
• Mindfulness and relaxation techniques
• Progress tracking and journaling features

The App is intended for educational and self-help purposes only and does not constitute medical advice, diagnosis, or treatment.

3. Eligibility

The App is available to users of all ages. However:

• Users under 13 years of age should use the App under parental or guardian supervision.
• By using the App, you represent that you have the legal capacity to enter into these Terms or, if you are a minor, that you have obtained parental or guardian consent.

4. Account and User Data

4.1 User Information

To use certain features of the App, you may provide:

• A name or nickname for personalization purposes

4.2 Local Data Storage

All user data, including your name, preferences, progress, and journal entries, is stored locally on your device. We do not:

• Create user accounts on external servers
• Store your personal data on our servers
• Require registration or login

You are solely responsible for:

• Maintaining the security of your device
• Backing up your data if desired (data will be lost if you uninstall the App)

5. Acceptable Use

5.1 Permitted Use

You may use the App for personal, non-commercial purposes in accordance with these Terms.

5.2 Prohibited Conduct

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Copy, modify, or distribute the App or its content
• Remove any copyright, trademark, or other proprietary notices
• Use the App to transmit viruses or malicious code
• Interfere with or disrupt the App's functionality
• Use automated systems or software to access the App
• Sell, resell, or commercially exploit the App
• Use the App in any way that violates these Terms

5.3 Compliance with Laws

You agree to comply with all applicable local, national, and international laws and regulations when using the App.

6. Intellectual Property Rights

The App, including all content, features, functionality, design, graphics, text, audio, and code, is owned by the Developer and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for personal, non-commercial purposes

6.3 Restrictions

This license does not include:

• Any resale or commercial use of the App
• Any collection or use of content for purposes other than personal use
• Any derivative use of the App or its contents
• Any downloading or copying of information for another party's benefit

6.4 Trademarks

"Exam Relief" and related logos are trademarks of the Developer. You may not use these trademarks without prior written permission.

7.1 Not Medical Advice

7.2 Consult a Professional

You should:

• Consult with a qualified healthcare provider before starting any new wellness program
• Seek immediate professional help if you experience severe anxiety, depression, or mental health crisis
• Not delay or disregard professional medical advice based on information from the App

7.3 Emergency Situations

If you are experiencing a mental health emergency, please contact emergency services or a crisis hotline immediately.

The App is not designed for crisis intervention and should not be used as a substitute for emergency mental health services.

7.4 Individual Results

Results from using the App may vary. We make no guarantees regarding the effectiveness of any technique or exercise for any individual user.

8. Third-Party Services

8.1 Advertising

The App displays advertisements through Google AdMob. By using the App, you acknowledge that:

• Third-party advertisements may be displayed
• Google AdMob may collect certain data as described in our Privacy Policy
• We are not responsible for the content of third-party advertisements

8.2 External Links

The App may contain links to external websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites.

9. Disclaimer of Warranties

9.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9.2 No Warranty

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content
• Uninterrupted or error-free operation
• Security of data transmission

9.3 No Guarantee

We do not guarantee that:

• The App will meet your requirements
• The App will be available at all times
• Any errors will be corrected
• The App is free of viruses or harmful components

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Personal injury or property damage
• Any damages arising from your use of or inability to use the App
• Any content obtained from the App
• Unauthorized access to your data

10.2 Maximum Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) OR $50 USD, WHICHEVER IS LESS.

10.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Developer and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the App

12. Modifications to the App

We reserve the right to:

• Modify, suspend, or discontinue the App at any time without notice
• Update or change the App's features and functionality
• Remove content or features without liability

We are not obligated to provide updates, maintenance, or support for the App.

13. Changes to Terms

We may revise these Terms at any time by:

• Posting updated Terms within the App
• Updating the "Last Updated" date

Your continued use of the App after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

14. Termination

14.1 Your Right to Terminate

You may stop using the App and uninstall it at any time.

14.2 Our Right to Terminate

We may terminate or suspend your access to the App immediately, without prior notice, if:

• You breach these Terms
• Required by law
• We discontinue the App

14.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• All locally stored data remains on your device unless you delete it
• Provisions that should survive termination will remain in effect (including Sections 6, 9, 10, 11, and 15)

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any dispute arising from these Terms shall be resolved through:

1. Informal Negotiation: First, contact us at dongupsikoloji@gmail.com to attempt to resolve the dispute informally.
2. Mediation: If informal resolution fails, the parties agree to attempt mediation.
3. Jurisdiction: Any legal proceedings shall be conducted in the courts of Turkey.

15.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements and understandings.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.

19. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
